General Conditions of Eligibility :
Condition 1:
Tenders from Joint ventures are not acceptable
Condition 2:
DECLARATIONS: The bidder shall submit the duly signed declaration furnished in the bid document.
Condition 3:
It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee& EMD into the respective receiving bank accounts of Karnataka public procurement on or before the last date and time of bid submission.
Condition 4:
The bidder is required to ensure browser compatibility of the computer well in advance to the last date and time for receipt of tenders. The departments shall not be responsible for non- accessibility of Karnataka public procurement portal due to internet connectivity issues and technical glitches at bidders end.
Condition 5:
The original documents should be produced for verification at any stage of tender process as and when sought for, failing which, the bids are liable for disqualification.
Condition 6:
Rates shall be quoted in price schedule in the website itself.
Condition 7:
The tender document is part and parcel of the agreement Condition
Condition 8:
conditional tenders are liable for rejection.
Condition 9:
The successful bidder shall give an undertaking that they would abide by the provisions of the Employees Provident Fund Act.
Condition 10:
The bidder shall obtain insurance coverage for all the workers deployed for this work.
Condition 11:
The successful bidder shall obtain ESI coverage for all the workers deployed for this work if required.
Condition 12:
The bidder shall quote his rates inclusive of GST and all other applicable taxes, levies, duties etc., as per the latest Gok and Gol prevailing as on the date of opening of financial bid.
Condition 13:
The bidder shall quote his rates inclusive of PF as per the applicable rate as issued by the PF department from time to time.
Condition 14:
KPCL shall recover the Income Tax, building workers welfare cess, at the prevailing applicable rates.
Condition 15:
The bidder should take into account the prevailing royalty charges while quoting their rates and shall be deducted from the work bills. The successful bidder shall strictly adhere to Rule 36 & 42 of Karnataka Mineral Concession Rules 1994 & its amendments thereof If the successful bidder/agency fails to furnish documents related to remittance of royalty charges for Coarse aggregate, Fine aggregate, murrum etc., as per Rule 44(4) of Karnataka Mineral Concession (amendment) Rules 2016, following penalty will be recovered from the work bills (1) A penalty of 5 times the royalty amount or A penalty of Rs.1500/- per ton for building stone and Rs. 3000/- per ton for sand as per Schedule 1-C in addition to royalty charges.(i) A penalty of 30% of total royalty amount and the same will be transferred to District Mineral Foundation Trust as per rule 36(A).
Condition 16:
The bidder should maintain register of workers deployed and wages paid for the workers and shall produce the documents whenever called for by the competent authority. Remittance towards PF shall be commensurate with the labour component of the work involved.
Condition 17:
Bidder should have independent PF code. The bidder shall remit PF of labourers to Contractors permanent PF code number only and not to the KPCL PF sub code.
Condition 18:
In case the dates notified above declared as holiday, the immediate next working day will be reckoned.
Condition 19:
If the Bidder makes any alterations in the conditions of the contract or puts any condition of his own, such tenders are liable for rejection.
Condition 20:
The bidder shall register himself under section 7 and their workers who will be engaged for the works under section 12 of the Building and other construction workers (Regulation of employment & conditions of services) Act 1996.
Condition 21:
Corrigendum/modification/corrections, if any, will be published in the website only.
Condition 22:
The bidder shall quote item rates on the basis of prevailing market rate.
Condition 23:
Bidders shall give declaration regarding payment of fair and reasonable wages which shall not be less than the minimum wages fixed by the government from time to time to the labours working under the contractor in the contract undertaken by him. Failing which, the bids are liable for rejection
Condition 24:
Any variation in labour wages made by the Government from time to time shall be borne by the agency. Any claim towards this variation will not be entertained by KPCL.
Condition 25:
In case of death of a contractor after executing the agreement/ commencement of the work, his legal heir (to be intimated at the time of execution of agreement by the successful contractor), if any eligible registered contractor and willing, can execute and complete the work at the accepted tender rates irrespective of the cost of the work after obtaining approval from competent authority.
Condition 26:
The successful bidder shall execute the agreement with KPCL by furnishing Contract performance guarantee (CPG)/Security deposit (SD) equivalent to 5% of the Contract amount plus additional security deposit for unbalanced tenders in accordance with clause no.25.5 of ITT in the form of DD/BG from any schedule bank acceptable to the Corporation in the prescribed format within 20 days of receipt of letter of intent (e-procurement portal https://kppp.karnataka.gov.in).
Condition 27:
Contract performance guarantee (CPG))/Security deposit (SD) should be valid for 30 days after the date of completion of defect liability period.
Condition 28:
Defect liability period for the work is nil.

Technical Qualification Criteria :
1 : Past Experience : The intending bidder should have satisfactorily completed (at-least 90% of the contract value) as a prime contractor, at least one similar work (i.e., Reaming/re-drilling of form drains / foundation drains in dams) of value not less than Rs. 137.25 Lakhs during the preceding five financial years i.e. 2018-19, 2019-20, 2020-21, 2021-22 & 2022-23. The past experience should be supported by original scanned copy of the certificate issued from state / central Government / Government under taking from officers not below the rank of Executive Engineer or equivalent cadre (Work done of previous financial years shall be given weightage of 10% per year to bring them to the price level of the financial year in which the tender is invited). : Work Done Certificate
2 : Past Experience : The intending bidder should have executed in any one financial year i.e., 2018-19 to 2022-23 the following minimum quantity of work. 1) Reaming/re-drilling of form drains/Foundation drains in dams : 4740 m : Others -- Work done certificate with executed quantity
3 : Capabilities of Vendor : Liquid assets and /or availability of credit facilities of not less than Rs.138 Lakhs (Credit lines/ letter of credit/ certificates from banks for meeting the fund requirement. : Line of Credit
4 : Capabilities of Vendor : Tender capacity - (A x N x 1.50 - B), where, A-Maximum value of works executed in any one year during the last five years (updated to 2023-24 price level) taking into account the Completed as well as works in progress. N-Number of years prescribed for completion of the works for which Tenders are invited for 0.50 years. B-Value at 2023-24 price level of existing commitments and ongoing works to be completed during the 0.50 years (period of completion of the works for which Tenders are invited) : Others -- tender capacity
5 : Financial Status : The intending bidder should have achieved in at-least any Two financial year a minimum annual financial turnover of Rs. 549.00 Lakhs in the last five financial years i.e., 2018-19, 2019-20, 2020-21, 2021-22 & 2022-23. Turnover certificate, duly certified by chartered Accountant shall be furnished (Financial turnover of previous financial year shall be given weightage of 10% per year to bring them to the price level of the financial year in which the tender is invited) : Audited CA Certificate of Annual Turnover
