1 Supply should be as per tender description, RDSO specification and Drawing Yes Yes Not Allowed 2 Purchaser reserves the right to place entire/bulk order on CORE approved firms for the tendered item. The approval status of the tender will be reckoned as on the date of opening of the E-tender and not thereafter. However, in case of downgrading/removal/suspension/banning after opening of E-tender, such changes shall be taken into account while considering the offers. Yes Yes Allowed (Mandatory) 3 [a] The tenderer must have supplied the same/similar items to this Railway or any other zonal railways/production units. Documentary evidence (such as R/Notes, TPI Inspection Certificate etc.,) must be furnished along with the offer evidencing the execution of such purchase orders. The tenderer with satisfactory past performance as mentioned above for supply of the same/similar items for a qty. of 10 percent or more of tendered qty. against a single contract or must have supplied at least 20 percentage of the tendered qty in multiple orders during the last five years prior to and excluding tender opening date may be considered (as responsive to S.Rly requirements) for placement of bulk and regular order. [b]. If such past performance level is lower, then the offer may be considered [as responsive to S Railway requirements] for placement of developmental order not exceeding 20 percent of the net procurable quantity. Tenderers, who have no past performance as above, may also be considered for Developmental orders. For consideration of such developmental orders, such tenderers must enclose along with their quotation, details of M&P testing facilities, QAP[if available], Technical manpower/financial status available with them and MSE/NSIC registration certificate for same/similar items. Yes Yes Allowed (Optional) 4 Dealers participating on behalf of OEM should upload tender specific authorization from OEM. Offers from sub dealers will not be considered. Yes Yes Allowed (Mandatory) 5 Bulk purchase [minimum 80 percent of net procurement quantity] will be made only from those sources who are appearing as Approved Vendors of RDSO/CLW/BLW/RCF/ICF/MCF/CORE etc. as available on UVAM. Wherever, Approving Agency has assessed the capacity cum capability of the firm and has cleared the source as Developmental vendor for placement of developmental order, developmental order up to 20% of NPQ may be placed on such sources subject to their name appearing as Developmental Vendors of RDSO/CLW/BLW/RCF/ICF/MCF/ CORE etc. as available on UVAM. The status of the firm will be reckoned as on the date of tender opening. Yes Yes Not Allowed 10/04/2024 14:306 Note: [A] if the tenderer himself is not the manufacturer of the item offered by him, he shall be duly authorized by the manufacturer of such item. Such tenderers must enclose with their offer a tender specific authorization from the manufacturer, a model proforma is given in Annexure- 2 [S.No.21] of bid document (attached). [B] The OEM/Authorized Dealers/Agents must comply the following conditions, failing which their offer(s) will be ignored: (a) In a tender, either the authorized agent/dealer on behalf of the principal / OEM or the Principal/ OEM itself can bid but both cannot bid Simultaneously for the same item in the same tender. (b) If an authorized agent/dealer submits bid on behalf of the Principal/ OEM, the same agent/dealer shall not submit a bid on behalf of another Principal/ OEM in same tender for the same item/product. [C] The onus of submission of requisite documents in support of supply performance such as { [i] Receipt Notes/Proof of acceptance of material by consignee OR [ii] Inspection Certificate with self declaration by the bidder that supply has been accepted by consignee, shall lies with tenderer. Furnishing of false declaration shall render termination of contract and further action as per terms and conditions of contract} lies with tenderers. In case the tenderers do not submit the requisitedocuments as detailed above along with their offer, the tender will be decided on the basis of their past supply performance records as available with SR [ if any] and no back reference shall be made in this regard. [D] In case tenderer participates as an authorized agent, then the performance as required above shall be that of Principal authorizing the agent. It may so happen that the agent has credentials of past supply for a different Principal but this will not be considered as performance for placing bulk order in case of change of Principal. [E] In case none of the firms who have participated in the tender, fulfil the criteria specified for regular order for bulk quantity, in para above, then the purchaser reserve the right to procure bulk quantity from the tenders who have participated based on other credential submitted by them in support of their offer. Total quantity to be ordered on developmental Sources shall be limited up to 20 % of NPQ in regular tenders. b) Approved Vendors shall be eligible for bulk order as per predefined tender conditions. (c)Where there is only single RDSO approved vendor for an item, Developmental order may be given to up 50% of NPQ on one or more Vendors approved as developmental vendors ( d ) Where there i s no Approved vendor f o r a n i t e m vendors may be considered for placement of bulk order without any quantity restriction. However while considering Such vendors, factors including p a s t performance capacity delivery Requirements quantity u n d e r procurement, nature of item, out standing Order load etc. will be considered, subject to rates being reasonable Yes Yes Not Allowed
